Ok I had my son in California but I live in nevada my sons father is not on the Birth certificate and he is saying he will take my son away because I am scared of his life choices and I don't want my son to be hurt. My question is can get 50/50 Custody of my son even if he is not on the birth certificate and my son has my last name?

10 months an we live 20 min apart in the same city Las Vegas

Dad is pretty much guaranteed to get joint legal custody and at least ample visitation (even if it's stepped up based on the age of the child).

He'll have to establish paternity first.
