Can an employer do this?

I have been talking to a potential employer off and on for the last few months. I was called again recently for another interview with the owner and asked by him to spend a day on the road with a manager to help him evaluate me to see if I was a candidate for employment. During the day spent with the manager, I learned that the owner had called one of my previous employers listed on my resume with whom I had a very rocky relationship and that this employer "did not help me any". This previous employer is not listed as a reference on my resume though I do have 5 references listed that will recommend me very highly to any employer. The manager had no knowledge if any of my favorable references were contacted, only that the unfavorable employer was called.

Three weeks have now passed and I have received no call from the employer concerning a job offer though I was highly sought after by the manager. I am left to assume no offer is coming due to the bad recommendation from the previous employer has swayed the owner to decide not to hire me. Is this fair?

There is nothing unfair when it comes to telling the truth so your former employer did nothing wrong when he answered the questions asked by your prospective future employer.
