Hello,
I listed and sold a 2007 Harley on craigs list. I explained to the person who perchased it that it had a salvage title. I explained the salvage title could be from anything from the bike falling over or a dented gas tank etc.. I let him know that before he came to look at it. It was not listed as salvaged on craigs list but was explained to anyone who called about it. He came to look at it with his father who took it for a test ride. He stated that it ran flawless. He seen the small ding in the tank and I explained that I replaced the exhaust, turn signal and headlight trim ring. I also had new tires placed on the bike. He offered me 5K for the bike and I told him I would need to think about it as I got several calls on it. I contacted him 24 hours later and asked when he could pick it up for that price if I sold it. He agreed to meet that Monday to purchase the bike. I gave him several additional parts for the bike and a helmet that I would no longer need.
So a week later he calls and says he didnt know that the front end hit another car (neither did I), he claimed it was dangerouse to ride etc... Then claimed it has a blown head gasket. I explained I did research before I bought it and all I could find is it was salvaged by insurance company. I put the parts listed above on the bike took it to Ohio inspection facility which passed it with no problems.
He now states he wants me to refund $780 or he is going to sue me. He claims I am liable for the things he is claiming wrong with the bike. ? Am I liable for any of this since I explained it was a salvage title, it passed Ohio inspection? I asked where he got the information that it rearended a car because I couldn't find that anywhere and he said oh, you can't find it on carfax etc... my mechanic said there are signs and idacations that is what happened to it.... So should I pay $780, or tell him sorry but you had the opportunity to check it, ride it etc... Thanks in advance for any advice....
