CVC 27315 Seat Belt Violation

Hi,

I received a ticket in California for the very first time around a month ago for driving a passenger who did not have her seatbelt on. Now this passenger is an international student, having arrived in the states fairly recently, she was not familiar with the mandatory seatbelt law. She did not get a ticket. I was not pulled over by a cop-- they were stopping every single car going one direction along one road for an unknown reason, and the cop happened to notice that my passenger was not wearing a seatbelt.

Is there any way I can appeal to the court for this reason?

It is the driver's responsibility not the passenger's to ensure that all passengers in your vehicle are wearing a seatbelt. I do not believe your explanation would be effective. This is the reason why you and not the passenger received a summons. You would do best by looking at the exact wording of the law that you were alleged to have violated to see whether what I am saying is accurate. It will probably start with something like "No person shall operate a motor vehicle when..."
