do fired NY employees have double jeopardy protection?

I would like to know if double jeopardy protection applies in New York to a case of an employee who was disciplined nine months ago on charges of poor performance (given at that time a "final warning") who was dismissed last month for the same charges of poor performance in the same period (a period ending nine months ago), there being no recurrence of the poor performance in the subsequent nine months.
 
There are no such protections; double jeopardy is a concept which applies to criminal law, not employment law.
