I have been employed with my company for 2 years in Massacusetts they recently found that I didn't sign an NDA and non-complete when I started.

Then a week after finding out I had no NDA, unrelated to the NDA they started action to fire/let me go. Which put me on the action to find a new job.

I am in talks with several companies in the same field and would like to accept a job with them based on not having a non-compete and honestly I don't want to sign the NDA either.

What leverage if any do I have?

Can I ask for a reasonable termination bonus/severance package in exchange for signing the NDA part and not signing the non-complete?

For details my salary is 136,000/year and with bonuses my first year with the company I made $197,000. I am specialist in my field and its hard to find other companies at this high level that would high and pay me. Which is my the non-compete isn't something I can easily accept and wouldn't have accepted it had it been asked of me when I joined.

Thanks for any help you can provide!

Sincerly,
Sally

Leverage?

You have none.

They have all the leverage and muscle.

They have the gold.

They shell it out to you.

They can fire you and not offer you an explanation.

If you're smart, sign the doggone NDA.

Or, put yourself at risk of being unemployed.

Come on, you're not seriously thinking of doing anything worng, are you?

Then signing it is meaningless.
