I've been fired for "misconduct" because I failed to report an existing condition that, under the circumstances, was the responsibility of a co-worker to report. Not reporting is a clear violation of policy and procedure. I was fired and the co-worker was given one week off without pay and put on a two month probation period. Is there a specific category of discrimination for a situation like this?

Think of it this way.

You have two children, Ray Ray and Junior.

Ray Ray forgot to cut the grass. You said, Ray ray, go cut the grass.

Junior forgot to wash the dishes. You grounded Junior for two weeks and took away his iPad.

Life isn't fair, and your employer has the right to fire Jimmy for being late 1 minute, and ignoring Jerry who comes in 30 minutes late every day.

Jerry is the owner's brother, and Jimmy is just some dude they hired.

Nope, nothing discriminatory in your situation.

They could even like the other person more than they liked you, not illegal.

No case....

Nothing you have posted even remotely suggests any form of illegal discrimination.

It's only illegal discrimination if you are terminated due to a reason prohibited by law (example; religion, race, gender....). I don't see any illegal discrimination based on what you posted. You need to look for other employment & file for unemployment ins. - the state will decide if you qualify.
