My boyfriend is being charged with a federal conspiracy to manf./del. over 50 grams of crack cocaine. He was recently told by his attorney that his mandatory minimum was enhanced from 10 years to 20 years because of a prior. In 2007 he plead out to a simple possession of less than a gram of an extasy pill. His lawyer said that charge was the reason for the enhancement. I want to know if they could just double his minimum even though the charge was possession- not with the intent to deliver or delivery. Or if there is any other way to get around the enhancement.
 
You should pick better boyfriends.
Yes, his prior conviction makes him eligible for the enhancement. He didn't learn his lesson so he gets a stiffer sentence the next time around.
Drugs are bad, mmmmkay?
 
I do think that's a bit ridiculous to incur such a huge enhancement time. . .
I think it's ridiculous that he did not get a clue after the first offense! Better to have someone like that off the streets.
 
It's easy to judge ... he's a repeat drug offender! If he wants to get around the enhancement, his lawyer will know how he can try to do that. I suspect his only real option is to agree to a plea deal that takes the enhancement off the table.
