Fired and very concerned

Friday I was fired from my job as a General Manager for a job shop. I worked for this shop for seven months. The reason for termination was lack of performance in this role.

Here is my concern, they offered me a severance package if I resign and sign a release. If I resign he is claiming I will still be able to collect as they will not contest my claim. Six weeks is clearly not enough time to mount an successful job search. On the other hand, I believe if they fire me I am eligible to collect. Hopefully this is enough info.

Why is six weeks not enough time to find new work? If you file for unemployment they (your former employer) may appeal that. During this time you may not recieve benefits at all.
 
Having done job searches in the past along with the current market. Leads me to believe, that it will take longer to find the right job. He has said he would not appeal my claim.
 
Generally, poor performance is not a disqualifier for benefits. Even if the employer did contest, as long as there was no misconduct involved, I would expect you to prevail.

Something to be aware of, depending on state law, the severance package MIGHT cause a delay in your UI. That is NOT the same thing as a denial, and I am NOT recommending that you refuse to sign the severance package because of it. Severance and a delay in benefits is better than no severance and immediate benefits. I'm only mentioning it so that you won't be surprised.
