hello, im in california, i just had a quick question, a friend of mine worked at a fast food retaurant as a manager for over 10 yrs, full time. They company staring getting strick on overtime. they warned everyone they didnt want any overtime done, or you would be terminated. My friend was closing one night, they were busy, they had given her a list of things that need to be completed that night before closing because the next morning there was going to be an inspector coming in to the restaurant. since it happened to be a busy night she could not get everything finished by the time shift was over, sos he decided to clock out being afraid not to get any overtime, and stayed finishing the job on her own time.. when the management found out they fired her for working off the clock.. but really no matter what decision she made seem that would of been the outcome.. she is unsure of what she can do to fight this any suggestions please???

there is not much he/she can do. the person has no suit and yes you can be fired for working off the clock. Sounds like there may have been more to the situation at the current time or even in the past. If they were a manager for 10 years then they should be able to find employment quickly at another resturant. Good luck.
