I was out ill the end of last year and had surgery and returned to work on Mar 5th. Due to my surgery I am now having some complications and been under doctors care. I have given my doctors notes to my HR department and she emailed stating if I dont return to work on this day I will be terminated. I responded letting her know I wont be back on that day due to being under doctor care and I understand I have no more time on the books and my FMLA is exhausted. She then emails me again asking for another doctors note and wanting to know why I am out and when I will be back. I dont want to go to full detail with her since its my medical condition, but I let her know that I need meds to be ok and if I go back to work I dont feel I can take them and do my job. I also work by myself on Saturdays and if i faint or have a problem there is no one there to help me. Wouldnt this be more of a liability to them? I sent her another note and explained that I dont know when they will be releasing I have a dibiliating conditon and even if I wanted to go back to work with my meds I cant drive nor am I able to work to my full capacity. She never responded to me and mailed me my check w/ sick and vacation pay all on it. Today I get another email from her stating they hired a temp to do my job and they are still thinking about what they will do with me and that they need another doctors note. I dont understand??? I was fired and now they are thinking of what they are going to do with me and all she says in her emails is that I dont have anytime on the books. She is stating that this is job abandonment is that correct? I know they dont want to pay me unemployment but she should not be saying its job abandonment when I am under medical care.
