How do I appeal this double citation/traffic violation? Help. MASS

How do I plead?

Hello, I'm new to the forum. I need help on appealing my traffic citations. I looked over the internet and couldn't find the proper information I needed so I decided to come here. I'm from out of state, but since I got pulled over in Massachusetts I figured this would be the best place to seek help.

My court date is tomorrow, 10/14/2014.


Information about me: Only seventeen. I've had my license for about a year and four months. This was my first citation/violation.

Citations I received: Violation Code 89/9 - Stop/Yield, Fail To* ($155) and 89/4A Marked Lanes Violation ($105)


What happened: I got pulled over by a state trooper for the two citations I listed above. I was driving on a rotary to get onto a highway with my two friends in my car. The passenger, my friend was giving directions at the time and gave me the incorrect directions. I didn't want to take the wrong exit and get stuck on the highway, so I put on my left blinker while in a "right lane only" lane. I waited for the traffic to pass and hit my spot to get into the correct lane. I than noticed a cop about 35 feet in front of me. About ten seconds later he turns on his lights waits for me to pass him and pulls me over. I put on my blinker, turn down the street and I clipped the curb. ( I know, stupid mistake. I was nervous because it was only my second time being pulled over) (My car at the time also had an issue with the alignment of the tires so in result the steering wheel was always a little crooked, making it more difficult to turn. ) After being pulled over, the cop was a complete jerk, and threatened to give me a third ticket because I was on my cell phone texting my mother ( car was on, but pulled over on the side of street) while I was waiting for him to return with my license and registration. ( I guess that's illegal) The reason I left my car on is because my car at the time also had a battery issue and I didn't wanna risk it not turning back on. At the end, the office says, "I hope this just ruined your day buddy, have fun paying $255"


Questions I have: What can I say to appeal the two tickets? Is it true that if the office doesn't show up to the court hearing than I automatically win the case? Did the office give me the marked lanes violation because I hit the curb?



I plan on saying that the office couldn't have properly seen me because he was in front of me, and his view was obstructed by the on coming traffic. I spoke with a few others and they told me the office pulled me over because state troopers have to make a quota by the end of the month. I could also say it was "age profiling/age discrimination" because there were three teenage boys in the vehicle.

ALSO. My friend recorded the entire situation. I'm a little nervous that if I do show up to court, the cop may be there and decide to give me the third ticket for being on my cell phone.

But, I'll try to help you.

What state issued your drivers license?

Were you a resident of THAT state when the citation was issued?

What state do you currently call home, today?

You aren't APPEALING these citations, buddy.

If this is your initial appearance, you're simply appearing and pleading NOT guilty.

The court may require you to post a cash bond to further contest the citations.

If that is the case, I suggest you call the court (or read the citation carefully) and make sure you have the money available to post the bond IF the court requires you to do so.

As a juvenile (or newly licensed driver), MOST states will revoke your driving privileges if you are convicted of a traffic offense.

You should check your state's DMV to see if that applies in YOUR case.

You aren't going to simply be able to show up, tell a story, get a couple buddies to tell a story, and get acquitted.

Any acquittal in traffic court is a rarity.

If the officer fails to show, the prosecutor will simply motion for the case to be continued.

That happens often, and a citation s rarely dismissed because the officer fails to show.

You bets option, if the court (or the prosecutor) offers it to you, is to take traffic school.

Your second best option is to request DEFERRED ADJUDICATION.

Its a lot like probation, stay free of any more citations for 90 days (maybe 60 or 120, ask the prosecutor), and the citations get dismissed.

Again, that will cost money, so you need to know HOW much to bring with you!!!!

That's the least likely thing to happen.

I'd simply not speak about things that aren't an issue.

Silence is golden, don't mention things that you haven't been accused of doing.
