I called into work on the day my grandma passed away and told the i would not be in. They said they understood. I called back when i knew when the funeral was and let them know i would be out for two more days and the said "OK". The day i was going back they called me and told me they didn't need me anymore so don't come in. My work goes by a points system i had 3 points and am allowed 9. When you call and let them know you only get 1 point but for some reason i got 2 points per day and that put me over the limit. So they fired me. They did not let me know that if i missed all 3 days that i would not be able to come back. I don't feel that this is right.

Why is it legal? Don't they have to inform you that you could lose your job? They gave too many points per day then the employee handbook says

No they do not have to inform you that you could lose your job. Actually you should already know that. I agree it seems unfair but it is not illegal and therefore not wrongful termination and not actionable

No, there is no law that says they have to warn you that your job is in jeopardy. The fact that they did not warn you may make it easier for you to get unemployment but it does not make the termination illegal.

If you feel that you were given too many points in error, you are free to bring that up with HR. But the termination is legal nonetheless.

Just to add to previous comments, read the employee handbook you were given when you joined that company and check out their absence policies (including bereavement). I am sure it is all disclosed there.

I would take the hand book to an attorney, depending on the state, and the wording in the handbook it could be a breach of an implied contract. The laws vary from state to state.

The points should not be taken if the absence is excused.
