Hello, My mother worked for this nursing home in Louisiana for one day and one of the resident had some money stolen by one of the workers. They don't know who stole the money but the manager decided to lay all the newly hired off with no edvidence that any one actually stole any money in her words (until this situation about the stolen money is cleared up all the newly hired will be layed off). The word leaked from the Human Resource Office that all the newly hired were black and no whites were laid off with the assumption that it must have been a black person who stole the money. I told my mom to talk to a lawyer and see do she have a wrongful firing/layoff case. Is there anything that she can do? Thank You. Rickey Johnson

It is legal to fire a person(s) due to "suspected" theft. The fact that all the firings were of a protected class might carry some weight. However what is the goal in this? What does the accussed expect to gain and what would be fall out?

Well, they actually laid off a few people that was newly hired until the situation is resolved and they might be called back, My question was do she have a leg to stand on for a wrongful firing/ laidoff suit. The company is basically saying that one of you stole the money and I'm laying off all of you until the guilty party comes forward or be found out. Thank You
