improper passing ticket then charged with left of center

My son got a ticket for improper passing he went to court plead not guilty. He recieved a summons in the mail the date of the offense is wrong and the charge is changed to driving left of center. Is this enough to have it thrown out
 
No. It is not unusual to have the charges amended. The date is easily correctable, and it may have been determined that the new violation was more applicable to the situation than the original one that was cited.
 
The police officer, highway patrol trooper, or the sheriff's deputy; merely allege a violation occurred.
A citation is issued, which also serves as a summons (in lieu of a physical arrest), and the driver's promise to appear is acknowledged by his or her signature.
In some cases, the prosecutor will summarily dismiss a citation before or upon the appearance date.
In other cases, such as your son's, the prosecutor will amend the charge (upward or downward) prior to the appearance date.

In most cases, its always wise to investigate traffic school or deferred adjudication.

Fewer than 5% of traffic court defendants receive anything other than a guilty verdict.
 
My issue witg this is that he actually rear ended the guy after the guy brake checked him over and over. The guy got out yelling why are you following me. He wasnt it just happened to be thw way home. The guy was let go by the officer and never asked for insurance for the accident
 
Maybe if Junior hadn't been following too close to the other driver, there would have been no need for 'brake checking' and he would not have rear-ended anyone.
 
I know if someone in front of me kept hitting the brakes I would have slowed down and given some room.
If this scenario resulted in an improper passing citation then it seems your son got caught up in a bit of road rage for which he can only blame himself.
 
Sometimes a traffic law attorney can help if a person wants to spend the money for one.
