You'll just have to wait and see what they say.
You guys have a very strong union, so work with the union.
We can't do anything for you, because you don't want to put your private business on a public forum.
So, work with your union, speak to a few disability lawyers, NYC and the 'burbs are full of them.
Plus, make sure you follow up with your medical providers.

Good luck.

But bear in mind OP, that being part of a union doesn't mean the company cannot fire you over lateness and absenteeism.

And if you were fired in 2009, I suspect that you'd be time-barred from acting.

If this happened 5 years ago, you are way past the statute of limitations. Any recourse you might have had is no longer an option. If you did have a disability which affected your work and for which there was a reasonable accommodation which could have allowed to to continue working, then the onus was on you to make the request and provide the documentation. It is quite possible that there was no accommodation which would have been reasonable, especially tolerating unplanned absences and tardiness.

Have to agree with Proserpina & Elle - don't see where you can do anything at this late date. Sorry.
