Hey there,
I'm looking for advice on an infraction and misdemeanor I received last night.
I'm 17 years old, and was given a ticket for over 100 mph (22348(b)), that's the infraction, at 9:35pm on the 101 just north of LA, which is a 65 mph zone. I don't have a provisional license because I moved from Hawaii about 6 months ago. When the cop saw my hawaii driver's license he also gave me a misdemeanor 12500(a) for being unlicensed in CA (you're supposed to get a new license within 10 days of moving, I hadn't partly because I would only have a provisional license then). Neither of the violations are correctable, and I have a courtdate in April to appear in juvenile court. The officer said that they might let me take care of it by mail, and yet on the back of my ticket the instructions say that as a juvenile I must appear in court with a parent or guardian and that I might not necessarily receive a courtesy notice.
My questions are how much the fine may be, if you think I will need to appear in court, and if I should try and get my CA license now, even though it will be provisional and could that mean a worse sentence?
On the back of my ticket it also says you are required to appear in court for a misdemeanor violation, which would be the unlicensed part, however, the cop only said (and wrote on the ticket) that a parent or guardian would be required for the over 100mph offense.
Should I consult an attorney? Is there any way I can prevent my parents' insurance going through the roof, or lessen the impact? Is there anything I can do to reduce charges?
Any help would be greatly appreciated.
