My jurisdiction is: Florida

on monday Oct 6th i advised that i was giving my two weeks notice and that Oct 19th will be my last day. The next day Oct. 7th i called in to work due to family issues i was having at home and at about 4:42 pm i recieved a message from my manager on my cell that as of that day they were resiging me due to the fact that i called out. My next scheduled pay day was Oct. 15th and on that day the company did not pay me my full check i was only paid 42.00 dollars. The way i look at it is that i was leaving but they let me go before i left so they fired me. They dont see it that way and it is on record that i resigned. Now what i want to know is that right. All i wanted was my full pay for my two weeks and they refuse to pay. Do i have a case???

No. They are under no legal obligation to pay you for time you did not work, even if you were willing to work it and it was they who chose to accept your resignation immediately.

They may accept your resignation to be effective any time that is convenient for them. There are good and valid reasons in some cases not to allow an employee who has resigned, to continue working. The law does not require that you be allowed to work out your notice.

Two weeks notice is a courtesy. It is not required by law. You could have quit with no notice; they can accept your resignation at any time. Works both ways.
