Sewage in Condo

Saturday morning i woke and was on my way to the bathroom when I saw some unrecognized stuff on the floor. Geeze it was human waste coming out of the base of the toilet, the toilet itself, the bathtub and the sink. I live in a condo high rise one floor up from the basement storage area. The sewage from the condo high rise was backing up into my condo only. For eight hours we tried to hold back the waste.

My question is who is responsible for the cleanup and associated charges? So far, no one has taken responsibility for the cleanup. The condo management team has said. I should pay the $250 deductible amount and my insurance company would pay a $5000 fee and then the management team will handle the cleanup and re-construction tasks. The managements cleanup company indicates the cleanup will include replacing the hardwood floors as well as the sub-flooring. The walls of the unit will also be replaced from the floor up to 3 feet up the wall.

The owners found a beer bottle stuck in the sewer line which caused the backup of sewage.

I had a similar experience in a condo I used to own and live in, and of course was on the bottom floor. The main pipe into our building had a defect and when it stopped up, I got flooded out. It was totally disgusting and unsanitary. I know where you are coming from.

Second, you will probably go back and forth on who's technical responsibility it is. My HOA agreed to pay for new flooring, and total clean up.

At this point it probably is ther responsibility but you'll have an uphill battle trying to get them to cover anything under their insurance. I would pay the 250.00 deductible, then hit then up for re-imbursement.

Did any other bottom floor units get flooded? This actually happened to my unit 3 times over the course of several years. It was a terrible hassle. I would consider putting the place up for sale if I were you. I got fed up with it especailyl with all the problems with the HOA and the complex was falling into disrepair to I moved out.
 
Thanks for your quick response. After the mess gets cleaned up, i agree, it may be time to move.
