My 19 year old son received a speeding ticket last Sunday in NC (found out when all the letters starting arriving from lawyers). He and a friend of his was driving to Boone, NC and was clocked doing 90 in a 55. This problem was compounded when the officer said he thought he smelled pot, called another car with a drug sniffing dog. They found a small pot pipe on the passenger side floorboard under the seat. He said that they were both going to jail unless someone admitted to owning this pipe. My son did. (this may or may not be the case). I know that this aspect of my question probably belongs in another forum but may have some bearing to what eventually happens on the speeding ticket. This is his first traffic ticket and has never had any other run in with the law. Court date is in March. I plan on getting a lawyer but my wife may talk to the Asst. DA Tuesday if possible and get the full picture and his suggestions. Does anyone have any other suggestions? Is it possible to get a Prayer For Judgement in such a case? And what would this really do ? Would the insurance points still be applied if a PFJ was given? or does that only apply to the legal penalties?

It is unlikely that he will be allowed PFJ but who knows. Retain an attorney in the area and I wouldn't use one that adveritses with a letter. You can expect to put down a retainer. probably 1000 to 1500 since it is a drug case.

A 90 in a 55 is probably too serious to be granted a PFJ, especially with the discovery of something drug related. PFG's are meant for minor infractions but this will be a midemeanor. An attorney can give the best advise, and your son probably needs a good one.

The following web sites can provide more info on the traffic and insurance related points.
