I was written a speeding ticket from an State Trooper in North Carolina. I was in the middle lane of a three lane highway. The Trooper said he was pacing me from behind for 1.8 miles and that I was speeding. I was not speeding, and if anything was not going as fast as he says. I understand I can pleed that down, but I want to know what my rights are and what might I do to plead not guilty and get a judge to decide in my favor?

I look forward to reading what others have to say. Thank you.

What were you written up for?

What kind of vehicle were you driving and have you ever changed the wheels or tires?

How do you know calibration of your speedometer is correct?

I was written up for doing 75 in a 65.

I drive a Nissan Maxima and yes I have changed the tires.

I do not know the calibration of my speedometer is correct.

But how does all the above apply to my question? I want to know what are my rights and what should I do or say to get this ticket dismissed?

In NC you can take a Prayer for Judgement and the ticket will not show on your record. However this can only be used once every three years. You would be better off to save the PFJ and show up in court and request a further reduction.

I think the PFJ only affects insurance points (not DMV points)?

If you have no previous violations, looks like there will be no insurance points for a 10 over:
http://www.ncsu.edu/stud_affairs/legal_services/legaldocs/Trafficpoints.htm

"*Points are not assigned for these violations unless the same driver has been convicted of at least one other moving violation during the experience period (the last three years)."

The reason for the wheels/tires question is if they have been changed to something not within manufactures specification, your indicated speed could be significantly incorrect. Might be worth having someone check the calibration. ThisTires Size Calculator can tell you how far off it might be.
