Termination Due To Injury

I work for the govt and on Sept 25th of 2007 I hurt my back at work. I received a bulging disc out of this injury. I have been out of work on workman's comp every since then. Today I get a letter from my employer that they are going to terminate me in 14 days since I have not been back to work since my injury. Is this legal? In this letter I got from them, I was told that I have 7 days to respond to this and if when I do get better that I can come back in a fully healed status, (which I won't) they said that they would put me into a job that I was qualified for "IF" they had one. I also talk with another employee who went through this and when she was "terminated" from her government job, she was dropped from Workman's comp. I am worried about this happening to me. Can workman's comp actually drop me if I am terminated from my job? Do I have legal rights if they do? I am not healed and with this bulging disc, there is no way I would ever be able to return to the heavy lifting job I had. What are my options here? I guess the real question is, "can workman's comp dismiss my case due to me being terminated even if my injury is not reconciled?" :eek::confused:
 
Your employer has held your job FAR longer than required to do by law. The maximum that they are required to hold your job for you is 12 weeks - yours held yours for a year. So yes, they may legally terminate your employment.

I don't know what you mean by, dropped by workers comp. You will be eligible for medical treatment for this condition until the claim is settled, regardless of your employment status.
 
Do you have a lawyer? If not get one and respond to the letter or your definitely gone.
