Theft of time

Waiting for decision from legal for "Theft of time". Is it better to resign or wait for decision with possible termination?

Company did an audit on vacation hours and turns out that I had stupidly forgotten to enter vacation hours over the last year - around 60hrs. 2wks ago I had an investigation with HR, they said they would forward all info to legal and should have a decision in 2 weeks (warning or termination). Yesterday was 2 weeks and HR said they still hadn't made a decision but I am more then welcome to resign, and she said that I won't have this option to resign after i hear legals decision. She stated that the reason for termination will be labeled as "Theft of time" - which I won't be able to claim unemployment. She also said that other people have been let go for the same reason.

The company also paid for my schooling for the past year (approx $8k). About 3 months into courses HR created a document stating that if I quit or am terminated that I will need to pay back all tuition in 30 days... however, I never signed this paper. Can they force me to sign it or pay it back if I never signed it?

Is it better to resign or wait for decision?
 
Do not sign anything without discussing it with your lawyer.

I'm a lawyer advising you not to sign anything.

If you resign, you may not get unemployment, either.

If I were in your shoes, I'd admit nothing, sign nothing, and would not resign. Wait. Sit tight and wait.

Never confess to anything.

Let them prove it.

If they can.

Choose wisely.
 
As I indicated on the other forum, if you resign you WILL not get unemployment. If you wait for them to fire you, you MIGHT not get unemployment.

It would seem a no-brainer to me.
