Geico new cheating practice

Last week I got a notice from Geico by mail about the next 6 months auto insurance renewal premium. I was shocked to see 41% increase. I called and learned they removed my "good driver" reduction and prorated everything else up because DMV informed them I have a speeding ticket in September 2024.
I never got a speeding violation in New York for life. I visited DMV last Friday and bought an Abstract for $10.00 ( Geico refused to compensate me such expense in a future).
At the time of the transaction at DMV, an employee shared a statement it is a very common nowadays practice from auto insurance companies.
I'm awaiting for Geico verdict this week. My question is : can I sue Geico for defamation or a fraud attempt?

Your beef is not with Geico but with the NY DMV. I have never dealt with such a group of incompetent bureaucrats as they are. Geico is reporting on the information they received, but the information came from the NY DMV.

I have no doubt that the NY DMV denied sending such a report to them. Trust me, Geico did not make this up out of their hat. But a year or two ago I was out over a grand because the NY DMV doesn't know its collective behind from its elbow; its right hand does not know what its left hand is doing, and it can't get out of its own way.

Defamation is the publication of a false statement of fact to at least one person other than the subject of the statement. The statement must be damaging to the subject's reputation, and, in most cases, it must result in financial damage. Nothing even remotely close to this happened to you.

There are several types of fraud, but none of them are applicable here. Apparently, someone made a clerical error. You caught the error and have worked with the company to have the error rectified. There's nothing fraudulent about that.

This is nothing but a customer service matter.

So it seems Geico "clerical mistake" caused my insurance premium jump, I have invested into the discovery ( no result yet on Geico end), provided as my defense and ...... what if Geico is gonna persist with that "mistake" ? I want to watch you feeling when you got a written document on a reputable letterhead stating your spouse cheated on you. Are you gonna discuss what defamation is, talk to your spouse or try to discover a "clerical error"? And what about your feelings after that ? Just curious.

Your hypothetical scenario is ridiculous and irrelevant.

Once this is cleared up, you'll almost certainly be able to have any additional premium that you paid refunded to you.

Can you sue? Yeah, if you are willing to pay a lawyer, and you can find one that can keep a straight face while meeting with you.

What would make more sense it to look for ways to lower your insurance.

I have no idea if your problem is a clerical error at Geico or at the NY DMV. Before you go on a rant about Geico, you should shop around and get some quotes from other insurance providers. If other insurance providers are willing to give you a deal, based on your driving record, and don't cite some speeding ticket, then it's a Geico issue. However, if the other insurance providers come up with similar results to Geico when they check your records, then it's a NY DMV issue.

While I haven't had the problems with the NY DMV that @cbg has had, I have had problems with another NY state agency.
