  • Believed by whom? Accusations of drug or alcohol use by one party or another in a custody dispute are about as common as the sun rising.

    If there is a legitimate worry for the children, a report should be made to child services (or your state's equivalent). Taking the neglected child to a doctor on a visitation would help, too. if a doctor can say with certainty that injury or illness is a result of neglect, then things look better. One parent accusing the other of neglect without an unbiased third party evaluation is likely to be dismissed out of hand.

    It would depend on the state and the details of the event? How has the alleged alcoholism endangered or injured the children?

    What kind of action are you seeking? (limits on visitation? a change of custody? a restraining order?)

    What you can do and how you can do it will depend on what the problem is, and what result you seek.
