HOA Patrol Impersonating Law Enforcement – ID Confiscation, Illegal Citations – Arizona (Need Legal Guidance)

Location: Arizona – Pinal County / SaddleBrooke HOA #2
Status: Not a resident of the HOA. I was on public roads working delivery (Uber Eats).


Summary of Issue:

I was stopped by a private HOA patrol working for SaddleBrooke HOA #2. They:

  • Pulled me over inside their community
  • Took my driver's license
  • Issued a citation for allegedly failing to stop at a stop sign
The individual was not a police officer or licensed security guard. He wore a patrol vest and claimed authority under HOA bylaws.


Why This Seems Illegal

  • No POST certification, badge, or law enforcement authority
  • No known contract with the Pinal County Sheriff's Office
  • I am not a resident, so their internal bylaws shouldn't apply to me
  • I have since confirmed via job postings that they lack DPS security licenses
  • I was later denied a copy of the citation
  • A deputy I spoke with vaguely referred to "bylaws" but produced no legal justification
This appears to be a clear impersonation of law enforcement, and potentially:

  • Violation of ARS §13-2406 (Impersonating a Public Servant)
  • Violation of my civil rights under color of law (18 U.S.C. §242)
  • Unlicensed private security activity under AZ DPS statutes
  • Theft or coercion if they collected fines

What I've Done So Far:

  • Collected audio recordings of HOA staff refusing documentation
  • Pulled two job postings showing no legal authority or security licensing
  • Filed reports with the Pinal County Sheriff, DPS, and Goldwater Institute
  • Preparing formal complaints to the Attorney General, Governor, and FBI

❓What I'm Asking:

  • Does the HOA have any legal ground to stop, cite, or seize ID from the public?
  • What are my legal options (civil suit, federal complaint, media pressure)?
  • Would this qualify under RICO or civil conspiracy, given the pattern and government inaction?
  • Should I pursue this as a Class 6 felony impersonation or constitutional rights case?
  • How do I force disclosure of any alleged "authority" between the HOA and sheriff?

Evidence I Can Share:

  • Job postings from Indeed (proving lack of law enforcement authority)
  • HOA traffic bylaws (internal only, do not authorize public enforcement)
  • Audio of HOA staff and security patrol denying access to citation
  • Names, location, and timeline of incident

The HOA is private property. While you are not a party to the HOA agreement that doesn't mean you may do whatever you like on its property. That said, if there were no signs or anything else giving you warning of the rules of road were in that HOA you probably can ignore that "citation".

The HOA employee doesn't appear to have impersonated a law enforcement officer. Your own observations at the time indicated that you knew that — he wasn't in the uniform of the local PD but rather wearing a yellow vest of the HOA, he likely wasn't wearing a badge, and my guess is that is that he never told you he was a police officer. In any event your only remedy about him impersonating law enforcement is to report what happened to the police. Just from what you've said in your post I suspect that nothing will come of it.

There are no civil rights violations involved here because he wasn't a government employee. For the most part our civil rights protect us from actions taken by the government. For example, the Constitution's Bill of Rights apply only to restrain the action of the government, not private persons/entities.

You've not indicated you suffered any financial or other damages from this incident. For most lawsuits you need to have damages to get anything from the defendant. There are few actions of private persons for which there are statutory damages. If what happened falls under some Arizona law for which you may recover statutory damages you may pursue that. I suspect that you'll find there isn't anything of the sort in Arizona law that covers what happened in this incident. There isn't any violation of federal law in this encounter.

I get that you're very upset at the guy for the stop and what transpired between you but I'm not seeing anything in your post that indicates there is anything here for you pursue other reporting what he did to local law enforcement, the HOA board and to the HOA member who ordered the pizza. Frankly your best shot to get any kind of consequence against the HOA employee may well be the customer you served. If he wants to keep getting food delivered to his home he'll want food delivery employees who are willing to deliver there. If they are going to get hassled like you did that will make it hard for residents to get what they want delivered and its the HOA members who have the most clout to force the HOA to do something about this employee.

You may, of course, consult an attorney or two in your area to see if they see anything worthwhile to pursue. If you were in my state I'd tell you to rip up that citation and simply forget about the rest and go on with your life. Life is too short to run around trying everything you can think of just to get some payback to the HOA employee for an encounter you didn't like. IMO you'd do better using that time to pursue other things that will enrich your life than spending a lot of time trying to make a mountain out of what strikes me as just an ant hill.

If there is no property manager listed, then you can contact the board members of the association.

Then why did you give him your driver's license? And did he give it back? If so, then you have no basis for any legal action. Also, your post is curiously silent about whether you actually did or didn't run the stop sign.

I disagree. Based on your story, this person made zero effort to impersonate a law enforcement officer. Regardless, you're free to report a suspected crime to the relevant law enforcement agency.

That would be a good question for an Arizona attorney familiar with the laws governing HOAs. No one like that posts here.
