I agree cbg. That's why I said if they are *just because of the exec. status* & not required by contract or law I don't see why they can't be taken away. OP should answer your questions for further information from us.
There is no FMLA law that says it must be allowed & there is no FMLA law that says the employer cannot allow it (though all employees must be treated equally). Many times it is in the employer's best interest not to allow it.

Just noted OP also started another thread with more details.
If you pay the civil demand, you "most likely" will not have criminal charges pressed against you though they still could. (They are 2 separate things.) If you don't pay the civil demand, the chances of being charged with theft "generally" increase.
They might still report you to a retail...
