Did you call the bank? Was the check cased? If so, was the endorser the intended party? IF not, did you let BoA know that the check was cased by someone other than the intended part? Did you file a police complaint?

Exactly! Most everything you find "unfair" in teen's/early 20's, you come to understand bit later in life...usually by late 20's/early 30's and definitely when you have children of your own.
Take all your information, along with criminal record, and consult with another DUI attorney. See what s/he has to say about the outcome and if you can/should appeal.

Have you tried calling Customer Service and speaking with a supervisor? That is what I would do...and I would keep going up the food chain until I received my refund.
