    I doubt he will sign. I would use a regular process server. They will send you the form to be filed with the court after they serve him. Service has to be by a disinterested party.

    They are correct for once. You can send him a letter CRRR allowing him permissive access and restricting the access to him only. That way it does not run with the land. However, if he is landlocked you may have to give him a ROW depending on the circumstances.
