Will I qualify for a PJC

Since you are out of state you do not qualify for a regular PFJ and this is a suspension of your right to drive in NC. Go in and talk to the prosecutor and see what you can work out. Reduction to a nine over is common (two points in SC) but you really need some type of deferment to keep the...

Corporate Law Partner wants to leave S-Corp

What does your operating agreeement of the LLC and bylaws of the S corp say? Opps, you didn't get any legal advice and have neither and are now crying in your soup. Unfortunately, you are the norm rather than the exception. Getting into business is easy, but getting out, there's the rub...

Prayer for Judgement for late registration and inspection

You can contact the court and get a continuance. If you are over 18 they cannot appear for you and a PFJ is not what you want to do. I don't think it is even available for these charges. Go to court and take all of your school info and info to show you registered etc and try to get the charges...

    Auto Loans Auto Loan

Your first step is to send them a letter CRRR demanding an accounting. Then you need to read your contract. It is possible there is a violation of the UCC but there is no way to know until you get all the information.

Do Previous Land Leases Transfer to New Owners?

They can't claim the land by adverse possession if the property was leased to them since the use is permissive. While your description of the situation is clear to you, it is not at all clear to me. I suggest that you see if the attorney is still around and have him explain your rights. If...

Stipulation for change of beneficiary on court-ordered life insurance

She is the beneficiary, not you since it is for CS, not alimony. The money will be put in a trust with a trustee that can spend the money as needed for her support. The policy needs to be in her name as the owner, that way he cannot change the beneficiary and you will be notifed if he does not...

Arrest, Search, Seizure, Warrant search of my home

If someone in control gives them permission. It does not actually have to be you. This is fact specific and it is unlikely that a trial court would toss any evidence. If she was not charged then it is moot.

Owner of Life Insurance Policy and Sole Beneficiary

He can sue based on undue influence but that is a very very difficult thing to prove, especially since you cared for her for many years. It just depends on what you want to do. You can wait and see if he sues or you can offer him a settlement.

    amending a separation agreement

As long as it has not been made a part of the court order simply execute a new agreement. Your attorney should be able to handle this with no problem.

can i use a prayer for judgement?

You can either use your PFJ or try for a reduction to a nine over on the speeding ticket. I don't think they will let you use a PFJ for an accident but I am not positive on that point. Call the clerk of court and ask.

Please advise...my mother has been held

You really don't need an attoreny to get her approved for Medicaid. However, what you probably need is a guardianship and for that you do need an attorney. She should have a caseworker that can assist you with these issues.

    no will, life insurance

I agree. See an attorney immediately. You should have notifed the insurance company at the time of his death. Now you will have to try to collect from her and that could be a real problem. Everything will depend on the exact wording of the court order and you can get a copy from the clerk of court.
