I have been offered a plea deal. No prison time/plead guilty to 2 Felonies/1 Misdemeanor.
First offense. Working at a Dept. store a friend came in faked a robbery, took $1600 dollars and my walkie talkie. I never benefited from this crime, got no money I paid the store back $1600. charge 13-2310A
Second offense, same friend was working at the Mall and we faked a robbery. He put 10 watches in a bag. That same day I pawned 2 watches. He pawned 4. Anyway
the Mall store got the watches back. charge 13-2310A
Third offense, are the watches Trafficking in stolen property 1st degree. charge 13-2307B
Questions: 1. While in Police custody and under investigation. A police officer came in (two cities involved) to question me and asked if I remembered my Miranda rights? Should he have read me the rights?
2. 13-2310A is a definition of Fraud Scheme and Artifices. 13-2310D determines the applicable punishment which is 13-1801 Definition. Which leads to 13-1801B which is a classification of theft. This leads to 13-1802 Theft Classification. Which leads to 13-1802G value of money taken. Is this how it works??
3. 1st offense had video surveillance and 3 officers wrote in the incident report that I was hiding behind counters communicating with the suspect on my cell phone.
Truth is my cell phone was not used after 9:06p incident 9:45p I have the billing records as proof. Plus I viewed the surveillance video it confirms that I was not on my cell. Yet the officers say they reviewed the video and say I was. Told my court appointed many times and he says nothing. Can I use this as a bargaining chip in the plea deal?
4. They got my cell phone. Cell phone was in my pocket. One officer said can I see your phone real quick I took it out no saying a word and handed it to her. She said can you open it and hand it back to me. I said it needs to be unlocked, I unlocked it and handed it back. One officer said in the report I said "sure" and handed off the phone. The other said I unlocked it showed her how it works and handed the phone to her.
Well that's my story I was trying to help a friend to pay someone he owed money to. I had 2 jobs going 2 college. I made a mistake my first. I'm not guilt.y of 3 class 2 Felonies. If you can help with any suggestions, Thanks. Need more info. let me know.
While being questioned at a Department store as a victim of a robbery I became the suspect. Two officers were asking me questions for about two hours.
1. I was under investigation, officers were looking through my cell phone, facebook and store surveillance video.
2. Seems like I was in police custody. About an hour into this I said twice I want to go home. This fell on deaf ears.
3. The info. that was found on my cell, they said it was a criminal offense but, I'm not under arrest.
Should I have been told of my Miranda rights?
