My 18 year old son, the driver, was recently pulled over in Nebraska. He had three other passengers, 18, 18 and 17.
A breathalyzer showed that the two age 18 passengers had been drinking, that my son had a very small amount (.000 something), and that the age 17 passenger had nothing to drink.
The two age 18 passengers had brought alchohol into the vehicle, which was discovered by the officers.
One of the age 18 passengers also had an open container in the vehicle.
Here were the charges:
Age 17 passenger: Nothing
Age 18 passengers: MIP
Age 18 driver: MIP, 2 counts Contributing to del. of a minor, Open container
Here is my question: What are the chances of getting the 2 contributing charges dropped? My son had nothing to do with purchasing or otherwise acquiring achohol, and in no way provided achohol to any minor. The two passengers had possession of it prior to my son offering them a ride. Would this be grounds to have these charges dropped?
