My friend and I got caught shoplifting at a store. The total amount that was took was $140. This is our first time ever being arrested we fully cooperated with the officer he then gave us a ticket and released us from the store. We were told we couldn't go to the store for 2years and if we did we would be sent out or arrested. We have a court date to go to and we want to know what most likely will happen? We are both 19years of age. We messed up big and are truly sorry and would never do this again. We want to try and get this off our record can someone tell us how we could do so? We are trying not to let our family find out. The store is also saying that they have see us shoplift there before which is not true. Should be plead guilty or what? Please help us we don't know what to do? We also are not sure about California laws? We are both College students and have Jobs we have a lot ahead of us and don't want a stupid, dumb, and bad mistake to mess us up. We feel horrible and embarrassed about all of this. :blush

First off the worst thing you can do is just plead guilty even if you are. If you do that then all deals are gone! In short you get whatever sentence Judge decides, not good option. What you want is ACD or Diversion (pretty much same thing). It might be called something different in your county. To put it simple it slike a guilty verdict with fines, probation etc. However once you completer program (generally around 6 mos) your case is dismissed. This means no record! Long as your records are currently clean and your county has such a program that is your best option other than aquittal. To find out about this start calling Attorneys, many offer free consultations, get as many as you can. When you meet with these Attorneys ask them about this option. If you can hire one of them if not on your first court date request public defender. do not attempt to handle this on your own
