Shoplifting, Larceny, Robbery, Theft above the law

Wal Mart sold an item that the cashier didn't put in my cart.It was in lost and found for a week until I could pick it up. The night before I went to the store, I called and was told it was at the courtesy desk waiting to be picked up. After over an hour at the store I was told it was resold.Others still had things at the lost and found, but mine was resold. I found out it was a hot selling item that wouldn't be available again. I believe they stole from me, and then sold stolen property. i paid for it I have the receipt.If anyone else in the store walked out with something that wasn't scanned correctly has bells and horns going off. which is embarrassing.And if it happened to be stolen from Wal Mart ,prosecuted to the fullest extent of the law. I want the same for them. And more. since it was known It was my property.that includes selling of stolen property. or are stores above the law and can't be held responsible for wrong doing?

I'm not so sure you can get all the way to they STOLE your property, but I certainly think they owe you your property back or the value of that property. It is even possible that they stole it, but a policeman and the DA are not going to want to prosecute it. Your best bet is to explain to the manager that you will definitely sue.
 
You are owed a refund, nothing more.
It isn't theft by any stretch of the law. You left the item behind.

also most managers for walmart will go above what you are actually entitled to. If you go and complain(and would do so in a polite manner) chances are you will be offered a little more than your item was worth...like a gift card. About 5 years ago I went in to buy a hunting coat that was priced at $20, well I get up to the counter and the very rude cashier starts laughing saying this coat is a $120 coat and that I should have known that the coat couldnt have been only 20 bucks laughing talking loud a line behind me saying i was trying to pull a fast one etc... it was rather embarassing. I went to the manager he saw the tag on the coat he appoligized and GAVE me the coat and a 25dollar gift card. Long story short(to late 4 that lol) Try being calm about the matter and you should walk out happy.

Yeah, I had the same question. Is Walmart selling one of a kind collectibles? If it is a "hot selling" item I would expect Walmart to find more of them to sell.
