I work at a PC repair shop. We had a computer that was checked in and to get disposed of. After I left work, the computer was found missing. Hours later, it was found outside the shop and has a user under my name along with a stolen part that was in it. My boss immediately called me and asked me not to come into work. Not given the chance to talk to him I just hung up and let it go. He also said that he's going to file a police report against me and said that for me to come clean with all the parts that i've stolen or he's got enough evidence to get me a record. All he has is a stolen part inside a computer that has my name setup on it. Is that enough evidence to say that "I" did it? B/C anyone could have done it. He is now blaming me for missing inventory that he don't even know what it is that he's missing. What can I do to defend myself? Do he have a case against me?

No one can say if he has a good case against you. But, he can report you to the police with as little or as much as he has. Whether that will be enough for the police to file with the DA and for the DA to proceed to trial, we can only guess. I'd say they have minimally enough to get it through the DA. You can bring up the "anyone" could have done it argument at trial should it get that far.

Coming clean with the owner is NOT a guarantee that you will not be reported or charged. You might want to consider a consultation with an attorney before you do anything that would be an admission of guilt.

I'm ignoring his calls to my cell phone.. would this make a negative impact if there was a trail? I can talk to him, but I would prefer not to. also, if he does bring the case against me.. what effect would it have on my permanent record? also.. can he show up at my house and search my house?

-Your former employer can't come to your house and search, but depending on evidence, police may do so (but it's doubtful).

Since your employer is taking such an agressive stance, you should cease talking to him. Remember to keep a record of everything that is happening, however.

I don't quite understand what happened. Someone came in to have you dispose of their computer? I trust this is a service wheras you recycle the computer and "wipe" their Hard Drive, or do you break it down to parts and use parts to refurbish?
