Shoplifting, Larceny, Robbery, Theft accused of identity theft

A few years ago, I had opened up a landline phone account under a relatives name (she lives in FL, I am in NY) She knew about this, was okay with it. I had the acct for about a year and then cancelled it, thinking I had paid in full. Apparantly, I was wrong as she just found a delinquent account on her credit report. I have the money to pay the bill, and am more than willing but according to everyone I have talked to with the phone company it will still be on her credit report as a paid in full charge off. She is saying the only way to have it taken off is to file a fraudulant charge and file a police report. I have no documentation or proof that she was okay with it. My question is this - if I have paid the account in full, can criminal charges still be filed and what can I do?

First of all, her credit report won't be magically cleaned up if she files the fraud report.

You should admit nothing, but pay off the balance.

If she files a police report, I doubt they'll go after you if it's paid in full.

Even if they do, they'd have to prove you to be the perpetrator.

Pay the debt and STFU!!!!

Don't worry about criminal charges. This is a civil matter between the two of you- and she should have known better because there was likely an underlying reason why you couldn't get it in your own name to begin with... lesson learned.
 
Thanks! It IS my debt and of course i want to pay it, im not even worried so much about charges to save face with the family, my main concern is jail time and stuff. As for proving me the "perpetrator" that would be open and closed, it was at my address. But I will. Paying it off and stfu'ing LOL..thank you. Does anyone know the chances of this becoming an issue with going to jail? Keep in mind I don't trust she'll say she knew about the bill.

You won't go to jail. This the USA. We let child molesters, rapists, and terrorists walk among us. Why would they even think about locking you up?
 
I have no idea...because I'm freaking out haha It's a he said/she said thing and it just doesn't look all that peachy for me, although the paying it off i would think would help.
 
My question is did you receive any final bills that showed it paid in full? I had something like this happen to me. I had a phone line while I still lived with my parents. When I moved out Verizon said they would send 3 more bills that should all show a $0 balance (just to make sure everything had caught up). They did arrive and all three showed nothing due. About 3 years later I get a bill from them saying I still owed on the account. I called them and got them to remove it. I didn't have the bills anymore, but I did point out to them that I had received the 3 bills showing nothing due, and they had not bothered to send anything to me until years later.

I think this is a scam that the phone companies sometimes pull. So that is one question you need to be asking is did you get anything that said the account was closed in good standing?
 
No, I never got anything stating the account was closed and in good standing, I had only paid what I *thought* to be the last bill, and then had moved. I don't know if it just didn't come, or if it did but I didnt get it because of the move. Either way it was a few years and im just now finding out about it.
 
If the only remaining problem is the credit report, have her enter a statement onto each credit report explaining the delinquent account. It won't go away, but at least any new creditors will have an explanation.
