I was a victim of robbery. Robbers caught quickly with my truck and many bags stuffed with articles. Some contraband and documents that might indicate criminal activity are found amongst articles.
Affiant states to magistrate that I claimed ownership of items and therefore i may be involved in crime. He recieves a over broad warrant for any and all evidence of crime in my home.
I was never as the victim allowed to see any contents of the bags taken as evidence. I never said oh those papers are mine. I was led to some bags of stuff and saw my computer tower sticking out and asked do those look like your things. I said yes.
I want to challenge the entire warrant and request all my stuff back. They took almost everything of my business and are holding it after expert and expert can't establish a crime.
I don't believe they had enough to go in and take it in the first place. Not to mention the difference in what the police neglected, the robbery and its details, which were heinous and involved my child of 9 years myself, home invasion, guns, and tied up, and instead they prefer to investigate the chance that financial crimes or fake id might be found in my house.
There is much more but in a nutshell, I want my motion for return of property to be really sharp and on target. If I don't do points and authorities real well on pro se they will just pass it off and deny. This entire parade was done on the hunch of a cop who thought the robbery was done in retaliation against me and that is now known to be a false notion.
What a crappy day I had. I had to congratulate my own self for how well I handled the event and made sure police apprehended the bad guys who hurt me and my little guy.(I sneaked out of the ties and dialed cell phone reall quietly to the cops. They have it all on tape. kinda cool!!
Any help with making a really effective and also correct attempt at this motion for special proceeding in the matter where charges were never filed but property taken would be so appreciated.
