Here is the situation:

Was at a store in GA. Removed a pair of headphones from the rack and walked around with it in my hands. Never concealed item and never removed item from packaging. Decided not to steal item and put it on a shelf. As I was exciting the store I was confronted by a loss prevention individual who requested I come with them. I did. They searched me and found no merchandise on me. However, they proceeded to press charges and I was arrested. Amount was <300$

Court is tomorrow. I have a lawyer but am curious as to how a defense could be played out in this instance.

Right, and that is in play. But most people here are LPs or SS right? I am inquiring as to how you can press charges without any item being concealed and returned to a shelf. What does LP or SS (secret shoppers) consider "theft"?
 
These laws vary by state. Without seeing the video (if any) or the LP statements its hard to say why you were stopped. Based on your post it seems you were wronged but again with the other sides view its hard to say
 
LP stated I walked around the store with the item in my possession. He also stated he watched me from the moment I walked in the door. I did think about stealing it and removed it from it's location on a rack, yet decided not to (which I know that excuse/defense is used all the time). I was attempting to make the right choice right then and there instead of continuing with the wrong one.

The video tape has been viewed by my lawyer and DA. My lawyer feels at least a diversion program is in order, yet DA is not budging. I got into trouble as a teen but haven't been in any trouble in 8 years. That is what DA is basing his decision on.
