Alcohol & Drugs: MIP, MIC, Intoxication Am I going to jail?

Back in May of 2003 I was convicted of marijuana possession it was put on a stet docket. It was one joint, I just recently pleaded guilty to another marijuana possession charge in July in 2007 that's in Federal court in Virginia. Am I going to Jail? I will be sentenced in December 2007. The amount is 65.00 worth.

It would depend on the sentencing guidelines of your county and DA's office…. Or did you say it was a federal charge??? If so federal guidelines will be followed and the judge has his discretion. It is not a one size fit all. Your priors and exact class of charges, when you where last charged, if you complied and helped the cops….and many factors. In some states you will get probation. Some could give you a short stay in jail to wake you up………It varies, so could give you hard time. Your lawyer will know. He alone knows more facts and should have advised you on this before pleading guilty.
