I was at my girlfriends house when my car's tire got slashed and I called my brother to come pick me up. It was saturday night so he had been at a party and drinking so he had his friend drive him to come pick me up. They picked me up and when we were turning onto my street a police car was parked right next to the turn causing the driver to swurve to avoid hitting it. Needless to say we were pulled over. They pulled the driver out and started questioning him because it was his friend's mom's car (the friend was sitting passenger next to the driver) and he didn't have his liscence on him and he was put in cuffs for suspicion of driving under the influence even though he wasn't breathalyzed and passed the field sobriety test. The other office came to my window and asked me if I had been drinking, I said no. He then asked why I was sitting infront of a beer. I told him I had no clue it was there (it was in the back pocket of the front chair under a peice of paper that only he could see because he was standing above the car at an angle on the sidewalk). It was not in plain view. HE then said well here's how I can prove it, and then asked me to hand him the beer. I said I didn't want to touch the beer if I didnt have to because that was a minor in possession. He thought I was being smart and so he pulled me out the car, handcuffed me and arrested me for a minor in possession. In my state they never arrest for an MIP only give you a citation. I think the police officer had something against me, for not handing hm the beer, based on comments he made to me at the substation.
On the police report very little is said about my arrest besides...
"passenger was found in possession of 12 ounce can of keystone light. The can was in plain view and found to be cold and in his immediate reach."
No other details were put into the report.
