I have already posted my case details in this site, but just telling it again. I have been caught shoplifting in a store and I have been arrested and the police were called and I have been given a citation. I have pleaded not guilty and requested for a court trial date. On the trial there was no prosecution and nothing and they have offered me a diversion program. In that I was asked to complete a program called shoplifting anonymous which takes around 6 hr video to complete it. I have received a 2nd date of court in July and on that date I need to show the proof of completion of the program, then all the charges will be dismissed and I am not convicted to anything. Here are my 3 questions.
1) I am a student of F1 Visa and I will be graduating in this August. After that I need to apply for OPT. The question can I write a letter to the judge saying that my condition is like this and I need to get this charges dismissed quickly and I also I am thinking to request him that I might be moving to a new place, so can I request for an early date i.e in june only because I have to apply for OPT
2) If I apply OPT without completing that 2nd court and without getting the charges dismissed, will this case effect my application of OPT and will my OPT get rejected because of that arrest record.
3) If I apply for that OPT late say in july after getting all the charges dismissed, then I am not convicted to anything, will my OPT get approved or rejected if I apply for an OPT after getting the charges dismissed, but it will still be there in my records because I need to do the expungement of the records and that process takes around 2 months, so it will easily take around sept or oct to get out of the records. So, if the records aren't expunged and I have applied after the charges got dismissed, will I get the OPT.
