Alcohol & Drugs: MIP, MIC, Intoxication Arrested at teh age of 20 for having alcohol in my system

hello,

I have a situation that i would like to get some advice on. Here is my story. I am 20 years old and i have a son that is two years old. I live on my own and live in Detroit. It was Friday night and i stayed home and had two beers. At about 1:30 a.m. My sister called me to pick her up from a bar in the city of Lincoln park which is about ten minutes away from my house. I arrived at the bar and parked across the street. She came out at about 1:55 a.m. I jumped in the back seat while her and her friend drove in front. We got about four blocks away from the bar and we were pulled over for a headlight being out. They had my sister take a breathlyzer and several under test which she passed. The officer was going to let us go but he asked everyone for indetification. When they discovered i was underage they pulled me out of the car and asked if i had been drinking? I told them no. I looked normal but she made me blow into the breathlyzer. I blew 0.05. I was soon arrested. My sister and her friend were both arrested also for providing to a minor. The cops tried making me say i was in the bar drinking with the girls of age. I had advice the officers I had just picked the girls up from the bar and i was at home drinking alone. i was charged for minor in possesion of alcohol. Which the cops did not find any liqour on me or in the car. It was in my system only.

Is there anyway i can fight this ticket and keep it off my record? How can my sister and her friend fight their tickets if I clearly told all officers I was never drinking with them? I live on my own with my son which i told the officers too. Should i seek a attorney to represent me? will this affect my record? What should i do? please help me!!!

The reason the officer may have ended up taking a final tough stance on you is that you admitted to drunk driving. Under 21 in Michigan if you have above a .02 level it's drunk driving.

Weight effects alcohol a great deal, but .05 is roughly what someone would have 20minutes after drinking 2 beers.

that being said, you should still hire an attorney. Make sure it's criminal defense, and if possible, one that deals with alcohol related crimes such as drunk driving or MIPs.
