My question involves criminal law for the state of: Arkansas
Hello I was arrested for hindering apprehension. My story:
I am a owner/landlord. A tenant was late one paying rent I go to check my apartment and find a guy occupying it. I agree to let him stay in the apartment and work off the rent. He works for me about 2 1/2 weeks. We are remodeling a home my cell phone rings and a person/stranger says he is a detective. Do I know this person? I say yes. Do I know where he is? I say no, the guy is right beside me with a hammer. I am afraid if he figures this out or if they come to get him there I will be in danger!!! The person on the phone says he wrote some checks on his brothers account and his brother is tired of it. I say OK. He ask me does this person live at my apartments? I say yes. He ask me not to tell him I talked to him and he will get him at my apartment. I say OK. good bye
I continue to work with him as normal hoping he hasn't figured this out, knowing I am going to take him to the apartment anyway. We finish our job and it takes about 2 hours. I am taking him to his apartment he calls his girlfriend who is in the area and I drop him off with her. They go to his apartment and he is arrested.
The next day I get a call from the detective he wants me to answer some questions. I say ok and he meets me with 2 other detectives. I admit to lying about being with the guy and tell them why. They say the guy told them I warned him. I say that doesn't make sense because he went right to them. If I had warned him he would not do that. The following day I get arrested.
My defense in my mind:
1. out of the blue I get a call a stranger says he is a detective. How do I know that!! no ID nothing, just a voice on the phone. He could be anyone.
2. I feel like the detective or stranger is putting me in danger. If I say yes he's with me what happens next. If he figures it out I knowing I turned him in. I am in danger and the detective is putting my life at risk, no one is there to protect me.
3. If I was hindering apprehension would I tell him where he lives and if I warned him why would the guy show up there?
I am hiring a lawyer to represent me, but any help legal advice would be appreciated. I know now I incriminated myself by telling the detective I lied. I am 44 yr old male with no record.
