I was arrested for pepper spraying my boyfriend,(misdemeanor) that I don't remember, I think I was drugged. The landlord called the police when the victim went to the landlord's apartment. This occurred at 7:00 P.M.on Valentine's day.
I don't do drugs and I was not drunk.I have no record, never in trouble. The victim has a record of domestic abuse on his ex wife that was pending at the time and a felony for battery on a child, 3 or 4 DUI's.
The state and the court did a withheld adjudication, $875. costs $104. to police dept.I told the court that I didn't understand, the court said: In return for a guilty plea on your part, I would sentence you as follows: I would withhold adjudication , The court, that means I will not find you guilty. So I agreed thinking that I was not guilty and I would not have a record.I'm pro bono and filed to the court to withdraw my plea,( they have put me in the system as guilty) I have court this week. Don't know what to do?

Okay, if you knew all those horrible things about the "victim", why would even say hello to it, less alone date it?

Keep to the facts.

You're about to blow a sweet deal.

This whole thing goes away upon your successful completion of a probationary period.

If you withdraw the plea, you'll still be convicted based on the facts you alleged.

You still might get probation, but this time the conviction won't go away.

You might even get some jail time, just to make the drink a little more bitter!!!

I would take the original deal, if I were you!!!!
