I am from upstate NY, but i was visiting my friends in the Air Force in NC this past weekend. On Friday night we went to a club that is 18 and up (I am 20). On our way out (as the club was closing), we washed the stamp off of our hands so we wouldnt have to scrub it off later. Outside, an officer approched me and asked for my ID. After i handed it to him he said he was writing me a ticket. He wouldnt tell me what it was for, so I asked him again. He began using vulgar language, and told me that i had to sit on the sidewalk. He told me that I was drunk. I hadnt been drinking at all and asked for a breathalyzer, which he refused to do.
After he wrote the ticket he asked me if i was going to appear in court. I told him that I am a full time student from NY and that I may need to look in to getting the court date changed. He then handcuffed me and made me sit in the car, however he did not read me my miranda rights.
At the police station they posted my bail at 2000 dollars. Three hours later they took me out of the cell and had me reappear infront of the magistrate and he told me that he was reposting my bail for 5000 dollars and it would be doubled if i did not appear in court. He let me leave without paying a cent.
The ticket says that I am charged with "posession of a malt beverage", but at no time was i seen inside, or outside of the club with a drink.
My question is, what is the best thing for me to do? I dont understand how severe this is, or what to do? Can i have an lawyer appear for me? Help!!
