Shoplifting, Larceny, Robbery, Theft attempted cashing bad checks

My friend and I were caught a few months back trying to cash a couple of bad checks at a local bank. The checks were in my name and I let him make them out to himself and attempt to cash them because he needed rent money for the next few months so I finally agreed. The checks were in the amount of $1,200 and $1,500 dollars. We were caught before we had a chance to cash them and the officers who caught us let us go with a warning only, so I thought everything was fine. Well about a month later a detective came to my home questioned me about the incident and gave me a misdemeanor citation (property theft) for the incident and I now have a court date. This is my first offence and I was wondering what my punishment would likely be (i've gotten arrested once before but it was for a suspended license). My friend skipped town and went back to Florida right after this happened so he of course hasnt been charged with anything. I've been really nervous that they are gonna give me a jail sentence
 
Explain the circumstances how you got caught... where were you? How were the checks bad? No money in the bank? Closed account? Were the checks fake?

Sorry guys. We were caught at the bank because we had been setting in my car outside of the bank for about an hour while my friend tried to make the checks look legit and the clerk thought it was suspicious and called the police. They werent fake checks and they werent on a closed account. The account had something like 16 cents in it I believe. When they caught us they said they bank didnt want to file charges so they let us off the hook with a warning. Well, for some reason a few weeks later a detective called me in for questioning and wrote me a misdemeanor citation for property theft. He wanted me to help him find my friend who did it with me but he left for Florida a couple weeks after we were caught. My friend is the one that filled out the checks and tried to cash them but I knew that I didnt have the money to cover it. I was just confised as to why they let us go and then charged me with it weeks later...Can they even do that?

Yes, they CAN do that.

First, consult an attorney. I do not know the laws in your state, but I suspect that you can be charged with multiple felonies. If they cited you for a misdemeanor, you are either darn lucky or they are trying to sandbag you.

I still don't get it. So you had a check made out to him for $1500 when you didn't have the money in the bank. No bank is going to cash that. I suppose since you KNEW they were bad checks that is an attempted felony larceny. I'm with CDW you need an attorney quick and be happy its a minor charge. Help them find your friend too, I have a feeling he knows how bad it is.
 
DId you actually get into the bank and try to cash the check or did the police contact you at your vehicle?

My friend attempted to cash one of the checks, I didnt attempt to cash one, all I did was give him the checkbook. The detective said that he should charge me with a felony and throw my butt in jail but he was gonna cut me a break and just give me a misdemeanor citation. I know now that what I did was a huge mistake and it is my first offense. I just hope I dont have to do any jail time over this. The detective acted like it wa really no big deal in the end which kinda surprised me. What do you think my punishment could possibly be?

You may not have attempted to cash the check, but you were a conspirator in the action. When you are a conspirator then it is essentially as if you had done the crime yourself.
You won't do any time in jail for this. You might get probation and have to pay some fines. The details on what exactly happened are still not clear though.
 
Since i'm pleading guilty I dont guess i'll need a lawyer? I hope i'll come out with probation and fines instead of any jail time. I will never do ANYTHING illegal ever again, this has been a major headache
 
Are you being charged with a felony? If so, you should certainly have counsel... good representation may get your charges reduced. Even if it is a misdemeanor you should still utilize the public defender at minimum... next time you appear in court just advise them that you want to speak with the public defender before proceeding further.
