Auto accident lawsuit

My jurisdiction is: New Jersey

I was involved in a car accident on 8/1. The person came in my lane and hit my car. The police were called and the officer wrote it up as the other party's fault. He was driving a rental car. The driver didn't report it to the rental car company. I called and filed a claim. Since then the rental car company hasn't responded. I am ready to take them to court. Do I sue the rental company or the individual?

The individual would be responsible, but you need to find out who the insurance was through. The driver may have declined the insurance through the rental agency, or only taken what would cover the rental car. Many regular auto insurance policies will also cover if you are driving a rental car.

If they had the insurance through the rental agency then you would collect from them, otherwise it would be the driver. I would name both in the lawsuit. If the driver did not take insurance through the agency, then you will find out real quick from them, as they will want to get out of a lawsuit.
