I was in a head on collision when the other guy crossed the center line. We were both injured and I am out of work for a possible total of 3 months. I did not have auto insurance at the time of the accident, but my minivan was completely undrivable and totalled. I gave the impound the title for it since I could not afford to do anything with it. I did not pursue the other guy and have no plans to, but I was told I had no legal rights to. The other guys insurance company called today and asked for a recorded, detailed account of what happened including all of the information that can be obtained from the police report, as well as an account of my injuries, my name, home address, employer, etc... i did receive one ticket for operating without insurance and am dealing with that in court right now. The other guy admitted fault, and it is also very clear on the police report that he admitted that to the police as well. My question is should I speak to the other guys insurance company? I told them I wasn't comfortable saying anything without getting advice first.
