Auto Shop performed repair on Vehicle! Car Burned down three weeks later!

Hello Everybody!! I am in dire need of your assistance.

I brought my car to a shop to be repaired. They installed an Exhaust Manifold and a Wiring harness to go with it!

Three Weeks later my car caught on fire while i was driving and burned down!!

My license was suspended at the time.(not anymore)

I towed the car to his shop and he said he wouldnt pay for it because he doesnt think its his fault!

If i take him to court will they revoke my license for driving on a suspended License at the time?

I want to sue, but if it would effect my licnese status ill take the loss!!

ANy help would do!! Thank you!!

I was thinking since im sueing for faulty work on his part, that my licnese status wouldnt even be taken into account!
 
Your lawsuit in civil court should have no direct influence on your license. However, nothing prevents the defendant or anyone else from using your testimony in the civil suit as evidence against you for a misdemeanor offense of driving on a suspended license.

You have to balance out the two ... is the recovery of the value of the lost car worth more than the potential fines and points (most of these are 2 points) on your license for a conviction for driving on a suspended license?

my car was worth around 6,000 dollars. So you're saying that if the defendant brought it up it could effect my license? He didnt know that my license was suspended at the time so i dont think he would bring it up.

You are free to bring a small claims action.

You will need to prove that the fire was caused as a direct result of the mechanic's negligence.

To do that, you'll need a couple of expert witnesses to testify supporting your allegation.

These expert witnesses should be licensed mechanics that will swear under oath how the fire was started by the shoddy work of the original mechanic.

If you can't have that done, don't bother filing a lawsuit. You can't prevail because you assume it to be so. It must be alleged and then proven by you.
 
Yes, you will have a hard time with this claim. Just because the mechanic worked on it three weeks prior does not make him responsible. You will have to get an expert to examine the vehicle and determine the cause of the fire and connect it to the mechanic's work.
Assuming that your insurance covred the loss of the vehicle, you will only be able to sue for your actual loss which will be your deductible.
 
I would just be careful of how you word this in court as it pertains to your license. Something like I had the work done and 3 weeks later the car caught fire. You get the idea. Don't mention the license issue.
