I have an issue with a former landlord (or Management team), and have been denied apartments since I moved out in November of 2007! I am unable to be approved for a home for myself and my family due to the reference that is being given from the Torrey Ridge Apartments. I resided there with my husband, and our 3 year old son for 6 months, and our daughter came 3 months before we moved out. We lived with a gas leak for 3 of the 6 months we were in the apartment along with numerous other problems that were never fixed! Upon moving out, on November 30, 2007, my husband did the final walk through and turned in the keys, and reciecved our final walk through paper citing we were only to pay for touch-up paint and general cleaning of the unit, and told to call in 30 days for the remainder of our deposit. I phoned the complex in January of this year (08) to get the remainder, and was informed we were being charged $2500 for damages, repairs, and rent for December! I requested they send me the bills for whatever damage they thought there was, and informed them that we did NOT reside in that apartment after the 29th of November and would not be paying them for rent of an apartment we did not live in! They sent me the bills, and their copy of the walk through. Among these documents was a clearly forged reciept for carpet replacement of the entire apartment, and their walk through paper which was altered to add all the false charges for the carpet, full painting, and 2 doors! The sliding glass door was severely damaged when we moved in and was noted. I do not know what other door they are referring to. I copied all of the falsified documents, highlighted the obvious alterations, and sent them back to the Property Management Company along with a very long letter explaining all of the issues we had while living there, the actual events that took place upon move out, informed them that if they did not resolve the charges I ould be contacting a lawyer, and accompanied this letter with proof. They dropped all of the damages charges, but because my husband didn't date the final walk through document at the time, they are still charging us for the rent in December!
It has been almost a year since we left this apartment, and have been unable to be approved for another one due to the bad reference this company is giving us! We have 2 small children! I need some information on what my rights are, and what I can do as far as taking legal action. I would greatly appreciate any advice anyone may have!!! Thank you for your time!

When you say you lived there for six months, did you have a six month lease or did you break the lease?

Did you give proper notice that you were leaving (typically 30 days in most states)? Just because you no longer resided in the rental does not necessarily mean you do not owe rent for it if you broke the lease early or did not give the proper amount of notice.

In other words, why did you leave after only six months?
